% 20.02.2020 This disposed of petition has been put up on office note today. A letter has been received from Central Jail No.2, Tihar, New Delhi to the effect that prior to grant of parole to petitioner on 22nd January, 2020 by this Court, parole has already been granted to the petitioner on 7th January, 2020 by the Government of NCT of Delhi for a period of four weeks from 9th January, 2020 till 7th February, 2020 and the petitioner has already availed of the parole. Learned counsel appearing for petitioner submits that he represented petitioner in this case being on the panel of Delhi High Court Legal Services Committee and on 22nd January, 2020 when this Court granted parole to the petitioner, he was unaware of the fact that petitioner had already been granted parole by the Government of NCT of Delhi on W.P.(CRL) 180/2020
7th January, 2020. He pleads inadvertence and submits that the order dated 22nd January, 2020 granting parole to petitioner be recalled. Mr.Jamal Akhtar, Advocate appearing for Mr.Rahul Mehra, Standing Counsel for respondent/State, submits that after availing parole from 9th January, 2020 till 7th February, 2020, petitioner has already surrendered before the concerned authorities. He further submits that parole granted to petitioner vide order of 22nd January, 2020 be not given effect to.
Heard.
In view of the aforesaid, the order dated 22nd January, 2020 passed by this Court granting parole for four weeks to petitioner is recalled. A copy of this order be sent to the Jail Superintendent, Central Jail No.2, Tihar, New Delhi as well as the Deputy Secretary (Home), Home (General) Department, Govt. Of NCT of Delhi, V Floor, Delhi Sachivalya, New Delhi for information.
