% 04.02.2019 CM APPL. 5208/2019 Exemption allowed, subject to all just exceptions. W.P.(C) 1152/2019 & CM APPL. 5207/2019 The petitioner has preferred the present writ petition to assail the order dated 26.11.2018 passed by the Central Administrative Tribunal ('Tribunal') in MA No.100/4817/2018 and 100/1945/2018 in Original Application No.100/1766/2018 pending before the Tribunal. After some arguments, Mr. Aggarwal, learned counsel for the petitioner seeks leave to withdraw the petition, under instructions.

The petition is dismissed as withdrawn along with pending application with the direction to the petitioner that he shall co-operate in the inquiry proceedings and shall not seek any undue adjournment. In case, the petitioner complies with the aforesaid condition, it shall be open to him to seek early hearing of his Original Application. In case, such an application is moved by the petitioner, the Tribunal shall consider the same on its merits.
