% 08.04.2016 O.A. No.289/2015 (against the order dated 16.04.2015) & IA Nos.15505/2015, 608/2016 1.

This O.A. is allowed with consent, but it is agreed that the applicant will pay a sum of Rs.25,000/- to the counsel for the defendant nos.1 to 6.

Costs be paid within four weeks from today positively.

The consequence of allowing this O.A. would be that IA nos.10230/2014, 10054/2014 and 10229/2014 filed by the applicants who claimed to be the LRs of the original plaintiff-Sh.Kishan Lal are revived but these applications will be decided in accordance with law by the concerned transferee court.

All the pending applications will be decided by the concerned transferee court.

An Office Order dated 24.11.2015 has been issued by Hon'ble the Chief Justice in exercise of powers conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015, whereby ordinary suits which are not commercial matters having pecuniary jurisdiction up to the value of rupees two crores cannot be tried by this Court and commercial matters up to the value of rupees one crore cannot be tried by this Court. Accordingly, this suit is transferred for decision to the jurisdictional Court under the District & Sessions Judge Rohini, North District, Delhi.

Let parties appear before the District & Sessions Judge Rohini, North District, Delhi on 17th May, 2016. Suit file be made available to the District & Sessions Judge Rohini, North District, Delhi on the date fixed.
