1. It is clarified that the Office Memorandum („OM‟) dated 8th November, 2019 agreeing in principle to grant the benefit of the additional Housing Rent Allowance („HRA‟) to those personnel of the CAPFs who are posted in the Kashmir valley, will become applicable from the date of their respective postings and not only from the date of issuance of the said OM.

2. The sum already recovered shall be refunded to the Petitioner within 12 weeks from today, failing which the Respondents will be liable to pay simple interest at 6% per annum on the said sum for the period of delay.

3. The petition is allowed in the above terms. The pending application is disposed of.
