This hearing has been done through hybrid mode. 2.
The present petition under Section 25B (8) of the Delhi Rent Control Act seeks the following prayers:- "a. Call for the record of case No. RC ARC 41/2018 titled as "Jagdish Lal Kalra Vs. Taj Singh", passed by Ms. Anuradha Jindal, Ld. ACJ-CCJARC/South West, New Delhi. b. Set aside the impugned order dated 12.11.2024 passed by Ms. Anuradha Jindal, Ld. AC.I-CCJ-ARC/South West, Dwarka Court, New Delhi in the case titled as Jagdish Lal Kalra Vs. Taj Singh", having case no. RC ARC 41/2018 "whereby the Ld. RC allow the petition for eviction filed by the Respondent and consequently passed eviction order without appreciation or facts and material on record and in violation or settled proposition or law.
c. Pass such other or further order/s as this Hon'ble Court may deem fit and proper in facts and circumstances of the case." 3.
Vide order dated 10.03.2026 this Court passed the following order:- "5. Learned counsel appearing on behalf of the petitioners submits that the latter shall vacate the premises within a period of six months from today.
6. In view of the above, learned counsel for the respondent submits that The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 21/05/2026 at 12:57:37
he shall not proceed with the execution proceedings till the next date of hearing.
7. Let an affidavit of undertaking to the aforesaid effect be placed on record by the petitioners before the next date of hearing. The undertaking will also include that they shall clear the arrears of rent, if any, and continue to pay the same till they vacate the subject premises." 4.
Today, learned counsel for the petitioner has handed up in Court an affidavit /undertaking dated 17.05.2026 in compliance of the aforesaid order, wherein it has been recorded as under:- "3. That in compliance to the order dated 10.03.2026 passed by this Hon'ble Court, I undertake that I shall Vacate the Suit Property within a period of six months from today i.e. 09.09.2026 and further undertake that I shall continue to pay rent till I vacate the subject premises.
4. That the Petitioner has already paid the arrears of rent till date to the respondent and till date there is no pending rent due upon the petitioner." 5.
In view of the above, learned counsel for the petitioner seeks leave to withdraw the present petition.

Leave granted.

The present petition is dismissed as withdrawn and disposed of accordingly.

Pending application(s), if any, also stand disposed of. 9.
Needless to state that the petitioner shall abide by the undertaking given by him.
