O R D E R

% 09.05.2026 Appellant being a registered owner has filed an appeal challenging the impugned order dated 21.12.2024 passed by the Tribunal Awarding compensation of Rs. 14,88,208/- along with interest @8% p.a. from the date of filing of the claim petition. The impugned Award hold appellant and driver jointly and severely liable to make a payment of the Awarded amount to respondents/claimants. the appellant on 09.03.2015 to M/s. Mahindra First Choice who in turn sold to the vehicle to third party.

On appeal, the appellant has deposited 30% of the Awarded amount along with accrued interest before the Registrar General, High Court of Delhi vide order dated 14.8.2025 and in terms of the order, the appellant deposited Rs. 11,49,361/- before the Registrar General, High Court of Delhi in the month of September 2025. After comprehensive discussion, it is agreed between the parties that on payment of lump sum amount of Rs. 12,80,000/- in favour of R-1 to R-5 (Claimants), the instant appeal be disposed off as settled as full and final compensation in respect of subject matter of instant appeal.

It is agreed between the parties that in addition to amount of Rs. 11,49,361/- already deposited, the appellant shall pay further sum of Rs. 1,30,639/- as full and final compensation in terms of settlement.

It is agreed between the parties that the said final settlement of Rs. 12,80,000/- arrived between the parties is inclusive of interest and inclusive of the amount already deposited.

Learned Counsel for the appellant submits some time to pay the remaining amount.

Learned Counsel for the appellant also submits that the statutory amount with interest, if any, may be refunded to the appellant.

In the Pre-Sitting Lok Adalat dated 10.04.2026, it was submitted that the settlement amount be released to the claimants as under:- The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

1. Mr. Sunil Kumar Gupta, R-1 (Husband of the deceased) 60% of settled amount.

2. Mr. Mohit Gupta, R-2 (Son of the deceased) 10% of settled amount.

3. Mr. Rahul Gupta, R-3 (Son of the deceased) 10% of settled amount.

4. Mr. Himanshu Gupta, R-4 (Son of the deceased) 10% of settled amount.

5. Ms. Akansha Gupta, R-5 (Daughter of the deceased) 10% of settled amount.

Learned counsel for Respondent no.1 to 5 have submitted today that the share of Respondent no.2 to 5 may be released to respondent no.1 and it is stated that "Affidavit of No-Objection" for release of the share in favour of respondent no.1 has already been filed and the same is on record. Appellant is directed to deposit the sum of Rs.1,30,639/- before the Registrar General within a period of six weeks failing which the same shall carry interest @9% p.a. on the delayed deposit. In view of the above submission of the learned counsel for Respondent no.1 to 5, it is directed that amount of Rs.11,49,361/- already deposited before the Registrar General in the month of September 2025 as well as a sum of Rs.1,30,639/- be also released to respondent no.1 subject to compliance of all the requisite formalities.

It is made clear that respondent claimant shall co-operate with the Appellant in the criminal proceedings.
