The Additional Public Prosecutor refers to the evidence of Himanshu, a crucial witness who is stated to have seen the petitioner accompanying other co-accused on his motor-cycle and returning with money which was counted in his presence the absence of the group coinciding with time of the commission of the offence of robbery. After some hearing, the learned counsel for the petitioner, on instructions, submits that he may be allowed to withdraw the present petition and the application filed therewith.

The petition and the application filed therewith are dismissed as withdrawn.
