After some hearing, the Petitioner is permitted to produce two witnesses - i.e., one witness from the MCD (Building Section) and the second witness from the MCD (Property Tax Section) to prove the records in respect of payment of property tax etc., The said witnesses shall be summoned for the date fixed by the Trial Court. On the said date, the witnesses would be given an opportunity to appear, and their statements shall be recorded. If they do not appear on the said date, no further opportunity shall be granted.

In the alternative, the Petitioner is permitted to place certified copies of the documents which he seeks to rely upon, after obtaining the same from the municipal authorities, which shall be then read in evidence, in case the witnesses do not appear.

The above permission is being granted subject to payment of Rs.10,000/- as costs to the Respondent due to the delay caused in the matter.

The costs shall be paid on or before the next date in the Trial Court. Considering that this is a Section 6 suit under the Specific Relief Act, 1963, The Trial Court shall dispose of the case expeditiously and in any event within a period of six months from today.

With these observations, the petition and all pending applications are disposed of. A copy of this order be sent to the Ld. ADJ (Central) - 10 in CS. No. 10462/2016 titled Ram Kumar v Satish Julka. PRATHIBA M. SINGH, J.
