% 23.01.2020 CRL.M.A. 1511/2020 (Ex.) Exemption allowed subject to all just exceptions. The application stands disposed of.

BAIL APPLN. 187/2020 The status report has been submitted on behalf of the State. On behalf of the applicant, it has been submitted that the investigation in the matter has repeatedly been reported to be in progress despite the FIR having been registered on 02.08.2017. It has been submitted on behalf of the applicant that the applicant has joined the investigation several times.

On behalf of the State, it has been submitted that the applicant has joined the investigation only once. The status report dated BAIL APPLN. 187/2020

22.01.2020 that has now been submitted on behalf of the State under the signatures of the SHO, PS Jaitpur is to the effect that the investigation is yet to be done from other aspects and custodial interrogation of the accused persons is required. It is however, specifically and fairly stated by the learned APP for the State after instructions from the Investigating Officer, ASI Pawan Kumar, PS Jaitpur that there is no further interrogation required to be conducted of the applicant and that he is not required for any custodial interrogation. It has also been informed on behalf of the State in reply to a specific Court query that there are no previous adverse antecedents against the applicant.

In the circumstances, the applicant is allowed to be released on bail in the event of arrest on filing a bail bond in the sum of Rs.1,00,000/- with one surety of the like amount to the satisfaction of the learned Trial Court with directions that he shall join the investigation as and when required, shall make no contact with the complainant or with any other witness, shall not leave the country and shall commit no offence whatsoever.

The application stands disposed of.
