% 13.08.2015 Learned counsel for the respondents states that the petitioner has now been posted to Ghaziabad. In these circumstances, learned counsel for the petitioner seeks liberty to withdraw the writ petition. However, it is submitted by learned counsel that the petitioner should be allowed to occupy family accommodation allotted to him at Badarpur till such time he secures a fresh allotment. Learned counsel for the respondents opposes this request and submits that there is a large waiting list. It is, however, submitted that the petitioner would be entitled to family accommodation allowance on his vacating the premises. In these circumstances, the petitioner is directed to vacate the premises at Badarpur within three months. Petitioner shall furnish an affidavit undertaking to this effect to the

court within two weeks with a copy to the respondents in this regard. The writ petition is disposed of with above terms. S. RAVINDRA BHAT, J DEEPA SHARMA, J AUGUST 13, 2015 rb
