% 25.01.2017 Marriage between the petitioner and Pranshu was solemnised on 09.05.2016 against the wishes of Pranshu's parents. The petitioner has filed the present petition under Article 226 of the Constitution of India seeking production of Pranshu as it is claimed that she was being illegally detained by her parents and cousin brother, respondents no.4 to 6 herein. On the last of date of hearing, Pranshu and her parents were present in Court. We had interacted with the parties. Pranshu had refused to join the company of her parents. Pranshu reiterates that she wishes to join the company of the petitioner. Counsel for the petitioner submits that petitioner and his family shall look after the welfare of Pranshu. It is also prayed that mother of the petitioner be appointed as guardian of Pranshu. Reliance is placed on Amit Kumar Shahi & Anr. v. The State Govt. of NCT Delhi and Ors., WP.(Crl).844/2016, decided on 18.05.2016;

Shamsuddin v. State & Ors., WP(Crl).13/2009, decided on 15.05.2009; and Court On Its Own Motion(Lajja Devi) v. State, WP(Crl).338/2008 decided on 27.07.2012.

Today the petitioner along with his father and mother are present in Court. They submit that they accept the marriage of the petitioner with Pranshu. They submit that they would look after the welfare of Pranshu. As per the record, Pranshu is about 171⁄2 years of age. Till she attains the age of majority, the custody of Pranshu is handed over to the mother of the petitioner.

The petition stands disposed of.
