Applicant seeks regular bail in FIR No. 445/2023 dated 07.05.2023 registered at PS Mangol Puri, Delhi for the commission of offences under Sections 302/34 IPC and Sections 25/27 Arms Act, 1959. 2.
Admittedly, earlier when the applicant had moved bail application before this Court, the same was disposed of vide order dated 17.05.2024 and the applicant was permitted to withdraw the abovesaid application with liberty to file the same after examination of the material witnesses. 3.
Learned counsel for applicant submits that material witnesses have been examined and, therefore, the present application has been filed. 4.
He, however, in all fairness, admits that after the abovesaid order dated 17.05.2024, he did not file any bail application before the learned Trial Court. 5.
After hearing arguments for some time, learned counsel for applicant, without prejudice to his rights and contentions, does not press the present application with liberty to file it afresh before the learned Court of Sessions. 6.
He, however, submits that in case, his such request is not acceded to by the learned Trial Court, he may be permitted to come to this Court again.
