% 04.02.2019 Learned Additional Public Prosecutor points out, on instructions from SI Ramesh Kumar, that charge for offence under Section 307 IPC has also been framed, to which there is no reference in the pleadings or in the prayer. The counsel for the petitioners regrets omission. Upon his attention being drawn to the ruling of the Supreme Court reported as Parbatbhai Aahir alias Parbatbhai Bhimsinhbhai Karmur and Others v. State of Gujarat and Another, (2017) 9 SCC 641, he now seeks permission to withdraw the petition and the application filed therewith. The petition and the application filed therewith stand dismissed as withdrawn.
