This petition is filed seeking directions to the respondent to carry out demarcation of the land of the petitioner described in the writ petition measuring 13 Bigha 4 Biswa situated in Village Bhatti, Tehsil Hauz Khas, New Delhi.

The brief facts are that the petitioner pleads to be the owner of the land and is in actual physical, cultivator possession. 3.

The petitioner filed an application on 26.09.2018 for demarcation of the land and deposited the fee in the treasury. 4.

The petitioner applied under the Right to Information Act, 2005 to know the status of the application.

On 13.12.2021, reply was received stating that the demarcation is only carried out in cases where the directions are passed by the Court. It is an undisputed fact that the land in question was urbanized on 20.11.2019. The issue that after urbanization of the land, which authority has to carry out demarcation is sub-judice before a Larger Bench of this Court. 7.

In view of the above, this writ petition is disposed of at this stage with the direction that the application of the petitioner shall be dealt by the competent authority as decided by the Larger Bench immediately after the decision of the Larger Bench.

In case of an inordinate delay, the petitioner shall be at liberty to avail remedies in accordance with law.

It is clarified that the application was made to the Revenue Department and in case the demarcation is to be done by another authority, the application of the petitioner shall be transferred to the authority concerned.
