Petitioner impugns order dated 15.01.2019 whereby, in the appeal of the petitioner impugning order on conviction dated 21.12.2018 and order on sentence dated 24.12.2018, a condition for suspension of sentence has been imposed on the petitioner to deposit the cheque amount of Rs. 18,95,031/-.

Learned counsel for the petitioner submits that the petitioner does not have the entire amount. He further submits that the petitioner shall deposit 50% of the amount and secure the balance 50% with some solvent security. He, however, prays that some time may be given to petitioner to deposit 50% and to provide the security for the balance.

Learned counsel for the petitioner submits that petitioner shall deposit 50% of the cheque amount within 30 days from today and CRL.REV.P. 138/2019

furnish solvent security of the balance 50% to the satisfaction of the trial court within 30 days thereafter.

In view of the above statement, the petitioner is granted 30 days' time to deposit, with the trial court, 50% of the cheque amount and further 30 days' time thereafter to furnish solvent security of the balance 50% to the satisfaction of the trial court. 5.

In view of the above directions, the petitioner seeks leave to withdraw the petition. Accordingly, the petition is dismissed as withdrawn in the aforesaid terms.
