% 04.02.2019 After some hearing, the learned counsel for the petitioners, on instructions, submits that he may be allowed to withdraw the present petition and the application filed therewith, the petitioners reserving the right to raise the contentions set out in the petition at appropriate stage during investigation and, if need be, thereafter before the concerned criminal court, the only request pressed at this stage bring that contentions and the materials as submitted in this petition may also be investigated into by the police. Learned Additional Public Prosecutor for the State fairly conceded that since the contentions urged in this petition and the materials filed therewith, seem prima facie to have some connection with the offences which are presently under investigation, the investigating agency assures CRL.M.C. 626/2019 Page No.1/2

that the same shall also be looked into, the grievance of the investigating agency on the other hand, being that the first petitioner is keeping himself away and not joining the investigation.

The learned counsel for the petitioners undertakes that all the petitioners will join and cooperate with the investigation. The petition and the application filed therewith are dismissed as withdrawn.
