% 19.03.2020 CRL.M.A. 5709/2020 (Exemption) Exemption allowed, subject to just exceptions. BAIL APPLN. 178/2020 & CRL.M.A. 5708/2020 The bail application has already been disposed of vide order dated 03.02.2020 and taken up on CRL.M.A. 5708/2020 filed on behalf of the petitioner seeking modification of the conditions as imposed vide order dated 03.02.2020 in para 8(a) thereof whereby it was directed to the effect that the applicant was to deposit a sum of Rs.10 lakhs in the form of FDR in the name of the learned trial Court within 30 days from the date of his release. The other condition imposed was to the effect that the applicant would furnish a bail bond in the sum of Rs.1 lakh with one surety of an equivalent amount.

It has been submitted on behalf of the applicant as also brought forth on a perusal of the application under consideration that the applicant has

since been released from judicial custody on 19.02.2020. It has been submitted on behalf of the applicant that the applicant has been unable to comply with directions dated 03.02.2020 of getting an FDR made in the name of the learned trial Court both from the Bandhan Bank and UCO Bank till date. The applicant thus seeks modification of the said term seeking that the FDR be allowed to be made in the name of the applicant and that parole 30 days be granted for the same.

Submissions have been made on behalf of either side. On a consideration of the submissions made, the term 8(a) of the order dated 03.02.2020 in Bail Application No.178/2020 is modified to the effect that the applicant shall deposit the sum of Rs.10 lakhs in the learned trial Court within one week from today in the form of a demand draft in the name of the trial Court which on deposit is directed to be converted into an FDR into an auto renewal mode by the learned trial Court. CRL.M.A. 5708/2020 is disposed of.
