The learned APP after getting instructions from SI Sonu Bhati who is present in Court, states that the Appellant Malkhan Singh has passed away. A copy of the death certificate of the Appellant has also been handed over in the Court. The death certificate is taken on record. 2.

The sureties are present in Court and they have also endorsed that the Appellant has passed away. Accordingly, presence of the sureties is dispensed with.

The appeal is therefore, abated qua the Appellant and disposed of accordingly.
