Learned counsel for the petitioner submits that the petitioner has died on 30.09.2024 and seeks time to move appropriate application. It is further submitted that since the petitioner/defendant had been sued in his individual capacity, the LRs do not have any right to continue with the suit and, therefore, this petition be dismissed as infructuous. 2.

It implies that the challenge to the ex-parte decree no longer survives, the amount of Rs.5 lakhs which has been deposited by the revisionist/deceased be released to the respondent in satisfaction of the execution which is pending before the Trial Court. 3.
