Bail Application on behalf of the Petitioner Raman Garg has been filed for grant of Regular Bail in FIR No.684/2024 under Section 85/ 316(2)/3/5 & 6 POCSO Act, P.S. Prem Nagar.

It is submitted in the Bail Application that Petitioner and the Complainant got married on 07.08.2023 in Arya Samaj Mandir, Vedic Mandal, Sector-14, Rohini, Delhi. The parties started residing cordially as husband and wife. After few days, family members of the Complainant called her to the parental home. Complainant started quarrelling at the instance of her family members. Between 09.01.2023 to 20.08.2024, the Petitioner and his family members made several efforts to convince the Complainant to join the matrimonial home, but their efforts did not succeed. Thereafter, the Complainant filed a Complaint on 23.08.2024 before ACP. CAW Cell, Sector-3, Rohini levelling false allegations of Domestic Violence, Physical Assault and Dowry. The Complainant also filed a case under Domestic Violence Act on 01.10.2024. She sought maintenance in the sum of Rs.40,000/- per month The counselling was done at CAW Cell. Initially the FIR was registered under Section 498A/406/34 IPC but on her subsequent statement implicating him in a false and fabricated rape case, Section 6 POCSO Act was added. 3.
The Petitioner applied for the Anticipatory Bail on 09.12.2024 in which interim protection was granted to the Petitioner. Eventually, the Anticipatory Bail Application got dismissed, by learned ASJ. 4.
The Petitioner has thus, filed the present Regular Bail Application. He is in Judicial Custody since 04.01.2025. It is submitted that the parties have arrived at a mutual Settlement, copy of which has been placed on record. The same be taken on record.

The Complainant is present in the Court, who endorses the terms of the Settlement.

The Status Report has been filed on behalf of the State today, which be taken on record. It is submitted that the considering the allegations in the present FIR, which are of grave nature, the Bail Application be dismissed. 7.

Admittedly, the parties have now entered into a Settlement whereby they have agreed to take divorce by Mutual Consent and to bring an end to all the pending litigations.

In view of the totality of circumstances including the Settlement, Petitioner is admitted to Bail, on the following terms and conditions: a) The petitioner/accused shall furnish a personal bond of Rs.35,000/- and one surety of the like amount, subject to the satisfaction of the learned Trial Court.
b) The petitioner/accused shall appear before the Court as and when the matter is taken up for hearing;
c) The petitioner/accused shall provide his mobile number/changed mobile number to the IO concerned which shall be kept in working condition at all times;
d) The petitioner/accused shall not indulge in any criminal activity and shall not communicate or intimidate the witnesses. e) In case the petitioner/accused changes their residential address, the same shall be intimated to learned Trial Court and to the concerned I.O.
