% 19.09.2024 I.A. 39859/2024 (on behalf of the plaintiff for withdrawal of the present suit under Order XXIII Rule 1 CPC) 1.
This is an application filed by the plaintiff under Order XXIII Rule 1 Code of Civil Procedure, 1908 ('CPC') seeking permission to withdraw the present suit in view of the settlement arrived at between the parties. 2.
It is stated in the application that the plaintiff on 10.09.2024 received payment towards full and final settlement of the present disputes raised in the suit.

Learned counsel for the plaintiff states that with the receipt of the said payments all the claims raised in the plaint stand satisfied. She states that further the plaintiff prays that Court fee be refunded in terms of Section 16A(ii) of the Court fee Act, 1870.

In view of the above, the application is hereby allowed. 6.
In addition, the registry is directed to refund 50% Court fee in terms of Section 16A(ii) of the Court fee in accordance with the rules. CS(COMM) 159/2023 7.
The suit is dismissed as withdrawn keeping in view the submission that all claims of the plaintiff qua the defendant stand satisfied and there is no cause of action surviving in favour of the plaintiff to continue the proceedings against the defendant.

Pending applications stand disposed of.
