O R D E R

This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:

"i. Issue a writ of mandamus directing the Respondents No. 1, in coordination with Respondent No.2 to 4 to conduct an urgent joint survey to demarcate plots and internal roads and identify all encroachments, illegal activities and unhygienic points at the premises namely Hari Om Shivaye Enclave, Pocket 13, Sector A-6, Narela, Delhi including initiation, conclusion and publication of a verification drive for owners/allottees to prevent further encroachment; The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

ii. Direct the Respondent Nos.1 to 3 to identify and remove the illegally run meat shop and slaughterhouse, other illegal structures/sheds, clear debris, and restore plots and streets to lawful status in the premises namely Hari Om Shivaye Enclave, Pocket 13, Sector A-6, Narela, Delhi; iii Direct the Respondent No. 1 and 2 to seal the establishments in the premises namely Hari Om Shivaye Enclave, Pocket 13, Sector A-6, Narela, Delhi which are found to be used for slaughter/retail within the pocket, confiscate the equipment used for the trade and enforce waste disposal norms at the cost of the offenders. iv. Direct the Respondent No.1 and 3 to initiate prosecution against the offenders including the Respondent No.5 and 6 for operating illegal slaughterhouse in the premises namely Hari Om Shivaye Enclave, Pocket 13, Sector A- 6, Narela, Delhi without statutory licenses and for sanitary violations and direct permanent cessation of such activities within the residential zone.

v. Direct the Respondent No.1 and 2 to demolish the illegal structures.

vi. Direct the Respondent No.1 to 4 to ensure installation of street lights and CCTVs in the premises namely Hari Om Shivaye Enclave, Pocket 13, Sector A-6, Narela, Delhi in a time bound manner to ensure removal of remove blind spots and cessation of illegal shelters facilitating illicit activity in the said premises.

vii. Direct the Respondent No.3 to intensify patrolling, deploy beat staff in peak hours, and conduct surprise checks and take prompt and necessary legal action against the offenders.

viii. Direct the Respondent Nos. 2 to 4 to permit the petitioner to install gates at the entry/ exit points of the Premises as per law.

ix. Direct the Respondent No.1 and 2 to take steps for immediate sanitation, waste removal, and pest control at the risk and cost of the Respondent No.5 and 6 in premises namely Hari Om Shivaye Enclave, Pocket 13, Sector A-6, Narela, Delhi;

x. Direct the Respondent No.1 and 2 to take proper steps to ensure that construction of a boundary wall around the perimeter of the premises namely Hari Om Shivaye Enclave, Pocket 13, Sector A-6, Narela, Delhi.

xi. Direct the Respondent No.1 and 2 to permanently remove all the unlicensed vendors and meat carts from the entry/ exit points of the premises namely Hari Om Shivaye Enclave, Pocket 13, Sector A-6, Narela, Delhi..." 2.

For the reasons stated in the petition, issue notice. 3.

Ms. Sabharwal, Mr. Burnwal, Mr. Sharma and Ms. Bhutani, learned counsels accept notice on behalf of the respondent Nos. 1, 2, 3 and 4 respectively.

There is nobody appearing on behalf of the respondent Nos. 5 and 6. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

However, the matter is being taken up for hearing. 5.

Ms. Sabharwal, learned counsel for the respondent No. 1/DDA, states that in the present case, the respondent No.1/DDA has already issued notices to the alleged encroachers and have further issued demolition notices as well. She states that action in accordance with law has already been initiated and would be taken to its logical conclusion expeditiously and not later than six weeks from today. She further requests the present petition maybe be treated as a complaint to the Sub-Divisional Magistrate (SDM), Narela. 6.

Accordingly, the present petition shall be treated as a representation by the SDM, Narela and further appropriate action in consultation with all the stakeholders shall be taken.

The present petition is disposed of with the aforesaid direction, along with pending applications, if any.

In case, satisfactory steps are not taken by the respondents individually and collectively, the petitioner will be entitled to revive the present petition.
