This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:

"a. pass an appropriate writ, order or direction in the nature of Certiorari, thereby quashing the impugned Eviction Notice dated 06.03.2026, bearing No.

F.1(Misc.)EE/EMD5/DDA/256, issued by the Respondent No. 2, being illegal, bad in law, violative of principles of natural justice and unsustainable;

b. pass an appropriate writ, order or direction in the nature of Mandamus, thereby directing the Respondents not to act on the impugned Eviction Notice dated 06.03.2026, in any manner whatsoever, so as to obstruct/disturb the lawful possession, use and occupation of the plot in question, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. earmarked for S. Personnel, in the sanctioned layout plan of the Petitioner Society."

Mr. Bansal, learned senior counsel for the petitioner, on instruction states that the entire structure on the plot shall be removed and vacant and peaceful possession shall be handed over to the respondent on or before 30.05.2026. Additionally, he states that the petitioners are occupiers of a house building society at Hargobind Enclave, Delhi 110092 and the same has 207 plots. In terms of the DDA policy, petitioner society is entitled to be considered for a plot for building community centre as the same would cater to the needs of the residents.

He further states that the petitioner shall make a detailed representation for allotment of a community centre plot as has been done for various other building societies.

The DDA may consider the request of the petitioner and pass a speaking order after hearing the petitioner /its representatives. The needful shall be done expeditiously in accordance with law and as per extant rules preferably before 30.05.2026.

Needless to add, the petitioner shall be entitled to challenge the order, if against the petitioner, in accordance with law. 6.
