The present writ petition has been filed seeking a direction to respondent-MCD to demolish the unauthorised construction in the property bearing no. 70/22,70/23,70/24,70/25, Gali Tanki Wali, Ghass Mandi, Hata Ki Tara, New Delhi-110006, and restraining respondent no. 3 from raising further unlawful construction in the said property. 2.

It is stated that the petitioner resides in the same vicinity in which unauthorised construction is being carried out by respondent no.3. However, it has not been stated as to whether the petitioner is an immediate neighbour and how the petitioner is affected by the construction. 3.

respondent-MCD on advance notice, submits that an order has been passed by MCD on 19th February, 2026, in terms of which Sanction Building Plan that was earlier issued in respect of the subject property has been cancelled. 4.

In view of the aforesaid, it is submitted that the subject property will be booked and further action in accordance with law shall be taken. 5.

Binding the respondent-MCD to the aforesaid statement, the present petition is disposed of.

It is directed that respondent-MCD shall take action in accordance with law, in an expeditious manner.

Needless to state, all rights, contentions, and legal remedies of the private respondent no. 3 are kept open.
