This petition has been filed challenging the Order-cum-Show Cause Notice dated 26.12.2019 issued by the respondent no.1 inter alia, suspending the licence of the petitioner till the final outcome of the Show Cause Notice.

The allegation against the petitioner is that a provisional licence was granted to the petitioner for operating Eating Houses with the condition that the petitioner shall obtain a Fire Clearance Certificate for the premises. Though more than a year had passed, the petitioner had failed to obtain the same. It is further stated in the Show Cause Notice that the cumulative sitting capacity of the entire building is 472 and in accordance with the National Building Code of India, 2016 and Urban Building Bye Laws, 2016,
a building where number of persons is more than 50, the same requires a Fire Safety Certificate.

The learned counsel for the petitioner submits that the petitioner has applied for Fire Safety Certificate by letter dated 09.01.2020. 4.
As admittedly, the petitioner does not have a Fire Safety Certificate as on today, I do not find any reason to interfere with the Order-cum-Show Cause Notice-cum at this stage.

It would be open to the petitioner to Show Cause against the impugned order. The respondents are directed to take a decision thereon, within a period of three weeks, after granting an opportunity of hearing to the petitioner.
