By filing the present writ petition, the petitioner is praying for extension of parole for a period of two months. 2.

Notice. Learned ASC for the State accepts notice. 3.

Learned counsel for the petitioner submits that vide order dated 23.12.2015 passed in W.P.(Crl.) No.3058/2015, the petitioner has been granted parole for a period of twenty days for surgery of his knee, which was to be conducted on 31.12.2015. Learned counsel for the petitioner further submits that the petitioner did not get admitted in the hospital on 30.12.2015 for the surgery as he could not arrange funds for the same. Learned counsel for the petitioner submits that now the petitioner has been able to arrange the funds and the doctors have advised him to get admitted in the hospital on 27th January, 2016 for surgery, hence the period of parole, which is going to expire on 20th January, 2016, may be extended for a period of two months.

Since the petitioner has already been granted parole for a period of twenty days for the purpose of surgery of his knee and it was for him to arrange the funds first and then avail the benefit of parole granted to him vide order dated 23.12.2015, the prayer of the petitioner for extension of parole is rejected.

The writ petition is dismissed. The petitioner is directed to surrender after expiry of period of parole granted vide order dated 23.12.2015. However, the petitioner is at liberty to apply afresh in case his surgery is to be scheduled in the end of January, 2016.
