% 05.02.2019 After some hearing, the learned counsel for the petitioner, on instructions, submits that he may be allowed to withdraw the present petition under Section 439 (2) Cr. P.C. assailing order dated 17.01.2019 whereby anticipatory bail has been granted to the second respondent, he reserving the right to file a fresh petition under Section 439 (2) Cr. P.C. in case the court of Sessions grants regular bail.

The petition and the application filed therewith are dismissed as withdrawn.
