It is stated by the learned Counsel for the Respondent that an Arbitrator Tribunal has already been constituted. This fact is not disputed by the learned Counsel for the Petitioner.

Let this Petition under Section 9 of the Arbitration Act be treated as one under Section 17 of the Arbitration Act by the learned Arbitrator. 3.

The Ld. Arbitrator is directed to decide the application under Section 17 of the Arbitration and Conciliation Act, 1996 expeditiously. 4.

In view of the fact that the notice was sent on 29.02.2024, the learned Counsel for the Petitioner is permitted to make suitable amendments bringing on record subsequent events that has transpired and permission was granted to add and amend the grounds as raised in the petition filed under Section 9 of the Arbitration and Conciliation Act, 1996.
