W.P.(C) 913/2020 & CM No. 2904/2020 (Stay) 1.

This petition has been filed by the petitioner challenging the debarment letter dated 20.11.2018 issued by the respondents against the petitioner.

Admittedly, the petitioner had earlier filed writ petition, being W.P.(C) No. 10986/2018, against the respondent, inter alia, challenging the order of termination and the invocation of the Bank Guarantees. The said writ petition was withdrawn by the petitioner on 12.10.2018 with liberty to avail alternate remedies. 3.

The petitioner has thereafter invoked the arbitration proceedings inter alia, challenging the impugned debarment letter

dated 20.11.2018. The said arbitration proceedings are stated to be pending.

In view of the above, the petitioner having already availed of the alternate remedies, I do not consider it proper to entertain the present petition. The petition is accordingly dismissed leaving it open to the petitioner to agitate all its claims in the alternative remedy already availed of by it.
