O.M.P.(MISC.)(COMM.) 157/2024 Present petition has been filed under Section 29 A (4) and (5) of the Arbitration and Conciliation Act, 1996 for extension of mandate of the learned arbitrator.
Learned counsel for the petitioner submits that the learned arbitrator was appointed on 23.09.2021. The pleadings were completed on 23.11.2022. It has further been submitted that the period was mutually extended on 01.09.2023. It has further been submitted that now the mandate is expiring on 01.03.2024. It has been prayed that the mandate may be extended for a period of 12 months.
Issue notice. Ms.Arti Bansal, learned counsel has accepted notice for UOI/respondent. Learned counsel has submitted that she has already filed the vakalatnama and she has got the instructions that the mandate may be extended.
The arbitration proceedings are at the stage of cross examination of the respondent's witnesses.
In view of the submissions made, the mandate is extended till 31.12.2024.
The petition stands disposed of.
