% 24.01.2018 It is submitted that petitioners and respondent No. 2 are living in the same locality.

Respondent No. 2 is having a mobile phone shop.

Petitioners came to his shop for re-charging the sim card. However, they did not make payment. A quarrel ensued on the point of payment wherein petitioners assaulted the respondent No. 2, resulting in simple injury to him and this led to registration of FIR No.39/2016 under Section 307/34 IPC at police station Jagatpuri, on the complaint of respondent No.2. It is submitted that petitioners and the respondent No.2 have settled their disputes amicably,therefore, aforesaid FIR and the consequent proceedings may be quashed. Respondent No.2 is present in court and has been identified by SI Rahul Kumar of police station Jagatpuri. Respondent No.2 says that he has settled the matter with the petitioners of his own free will,

voluntarily and without any undue force, pressure or coercion and has no objection in case FIR is quashed. Affidavit of respondent No. 2 is also on record.

Keeping in view the settlement arrived at between the petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Dasti. A.K.
