The Petitioner has approached this Court with the following prayers: "a) Pass an appropriate writ order or direction thereby directing the passport authority to renew the passport of the Petitioner for a period of 10 years. b) Pass any such order as may deem to fit and in the interest of justice, equality and good conscience." 2.

Material on record indicates that an FIR bearing No.29/2000 was registered against the Petitioner on 24.01.2000 at Police Station Karol Bagh for the offences under Sections 489B, 489C, 120B, 121, 121A, 122, 123 of the IPC. 489B, 489C, 120B of the IPC. An appeal has been preferred by the Petitioner against the Order and Judgment dated 18.04.2007 and the sentence of the Petitioner has been suspended. 3.

In view of the above, this Court is of the opinion that it is for the Appellate Court to decide as to whether the Petitioner's passport can be renewed or not.

Confronted with the aforesaid, the learned Counsel appearing for the Petitioner seeks permission to withdraw the present writ petition with liberty to approach the concerned Court by moving an application for renewal of the passport of the Petitioner.

Permission and liberty, as sought for, are granted. 6.

The writ petition is disposed of, along with pending application(s), if any.
