The present petition has been filed for directions to the respondent to establish a modern pig abattoir to avoid the slaughtering of pigs at private accommodation/places. There is a further alternate prayer for prohibiting the respondent/Municipal Corporation of Delhi ("MCD"), from interfering or putting any restriction upon the petitioners to slaughter and sell the pork (pig meat), till the modern pig abattoir is established and operated by the respondent.

Learned counsel appearing for the respondent has drawn the attention of this Court to the affidavit filed on behalf of the MCD, wherein, the various efforts made by the MCD for setting up of modern pig abattoir, have been detailed.

A perusal of the aforesaid affidavit, filed on behalf of the MCD, shows that the MCD has been making efforts time and again for establishment of a modern pig abattoir. However, the said course of action does not seem to materialize in something concrete, in the near future. abattoir is set up in larger public interest, at the earliest. For this purpose, the MCD shall also coordinate with other stakeholders, viz. Delhi Development Authority ("DDA"), and the Delhi Government.

Upon pointed query by this Court, it is informed that sale of pig meat is not banned in Delhi. In this regard, this Court takes note of the order dated 14th February, 1992, passed by the Division Bench of this Court, in Civil Writ No. 250/1992, wherein, it has been directed as follows: "xxx xxx xxx In the meanwhile, the Petitioners would continue to use their private slaughter houses for slaughtering pigs but the same cannot be regularized by the Municipal Corporation of Delhi after seeing sanitary conditions so that the neighbourers are not affected. If the sanitary conditions are not fulfilled by the Petitioners, it will be open to the Municipal Corporation to challan them or proceed against them in accordance with law.

Considering the submissions made before this Court, and considering the fact that the establishment of a modern pig abattoir would take a long time, in order to protect the interest of the petitioners, it is directed that the petitioners would be allowed to use their private slaughter houses for slaughtering pigs. It is further directed that the petitioners would maintain the said slaughter houses in hygienic conditions. However, in case, the sanitary conditions therein are not found to be viable or proper, the MCD would be at liberty to proceed against the petitioners, in accordance with law.
