After arguments, this appeal is disposed of as withdrawn, and it is observed that since the suit of the appellant/plaintiff is dismissed by the impugned judgment, and this appeal is also being withdrawn, so far as any issue of negligence against the appellant is concerned, and as held in the impugned judgment, the same will not operate against the appellant/plaintiff, clarifying that since the suit is dismissed, there would stand no claim of any nature by the appellant against the respondent/defendant which was in issue in the subject litigation.
