The present petition is being filed on behalf of the petitioner seeking quashing of the impugned orders dated 19.01.2023 and 25.02.2023 in Criminal Appeal no. 364/2018 passed by learned ASJ, Saket Courts, New Delhi and the impugned orders dated 13.08.2018 and 01.09.2018 in CC no. 444/2016 passed by learned MM-01, N.I. Act, Saket Courts, New Delhi and for compounding of the offence u/s 138 NI Act and acquittal of the petitioner and for cancellation of NBW directed to be issued by the Ld. ASJ vide order dated 25.02.2023 on the grounds of compromise and settlement. 2.

Learned counsel for the petitioner is ready and willing to compound the offence and vide the impugned order, though was directed to pay fine amount of Rs.25 lacs, has settled the matter with the complainant/ respondent for a sum of Rs. 35 lacs.

The complainant/respondent is present in Court and has handed over self attested copy of his Aadhar Card as well as gate pass. on record. He submits that in terms of the settlement, he has received a sum of Rs.31 lacs and further has been provided with PDCs of Rs. 4 lacs, which are payable every one month.

At this stage, learned counsel for the petitioner submits that the petitioner is ready and willing to replace the aforesaid PDCs of Rs. 1 lac each with a demand draft bearing no. 971932, dated 16.09.2024, of sum of Rs.4 lacs, drawn on IDFC First Bank, Gurugram, Rosewood City Branch and assures that the same is valid and good for encashment. 5.

The demand draft has been handed over to the respondent, who submits that he has no objection if the matter is compounded. 6.

Accordingly, the offence stands compounded and the petitioner is acquitted of the offence.

Petition stands disposed of.
