% 06.02.2019 Challenge in this appeal is to the order dated 26.10.2018 by which, an application filed by the appellant seeking amendment to the petition filed under Section 10 of the Divorce Act has been rejected. Counsel for the appellant submits that he would not press the appeal but seeks leave to file a fresh petition in accordance with law incorporating all the grounds, which are available to the appellant. Since the appellant wishes to include subsequent events, the liberty as prayed is granted. The appellant may file a fresh petition after withdrawing the petition pending before the Family Court.
The appeal is dismissed as not pressed. Cost of Rs.5,000/- imposed by the Family Court is waived off.
