The petitioner assails the order dated 02.02.2026 passed by the learned Sessions Court in an appeal arising out of a conviction under Section 138 of the Negotiable Instruments Act, 1881 ["NI Act"]. 2.

By judgment dated 05.08.2025, the learned Magistrate convicted the petitioner for the aforesaid offence. Subsequently, by order dated 18.08.2025, the petitioner was sentenced to pay a fine/compensation of Rs. 74,00,000/-, and in default thereof, to undergo simple imprisonment for a period of three months.

The petitioner has filed an appeal against the said judgment of conviction and order on sentence, in which he applied for a waiver of the pre-deposit required by Section 148 of the NI Act. 4.

Learned Sessions Court, by the impugned order dated 02.02.2026, has granted substantial concession and directed the petitioner to deposit CRL.M.C. 1956/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. only a sum of Rs.10,00,000/-.

Mr. Vaibhav Verma, learned counsel for the respondent, is present on advance notice.

After some hearing, and with the consent of learned counsel for the parties, the amount of pre-deposit is reduced from Rs. 10,00,000/- to Rs. 8,00,000/-. It is noted that the time granted for deposit is 60 days from 02.02.2026, and the appeal is listed for arguments on 19.03.2026. Mr. Verma submits that, subject to the convenience of the Court, the appeal may proceed for hearing on the date already fixed. 7.

The petitioner is at liberty to move an appropriate application before the learned Sessions Court, if necessary, for grant of suitable instalments for deposit of the amount.

The petition, alongwith pending applications, is disposed of with these directions.
