$~18 * IN THE HIGH COURT OF DELHI AT NEW DELHI + O.M.P.(MISC.)(COMM.) 53/2019 PREMIUIM PRESSURE VESSELS PVT.LTD.
..... Petitioner Through:
Mr. Chirag Deswal, Advocate.
versus EVEREST INDUSTRIES LTD.
..... Respondent Through:
Ms. Vasundhara Nayyar, Advocates.
CORAM:
HON'BLE MR. JUSTICE RAJIV SHAKDHER
O R D E R
% 27.02.2019 1.
Ms. Vasundhara Nayyar enters appearance on behalf of the respondent. Ms. Nayyar says that she does not wish to file a reply as she has no objection to the prayers made by the petitioner in the petition. 2.
The record shows that the learned Arbitrator on being appointed vide order dated 06.07.2017 entered upon reference only on 19.08.2017. It appears that after the expiry of the statutory period of 12 months, the respondent did not agree to a further extension of time. It is in these circumstances that the petitioner has approached this Court for extension of time. I am told by counsel for the petitioner that the matter is at the stage of evidence.
3.
Given the time and money invested by the parties, I am inclined to extend the time till 31.05.2019 for concluding the arbitration proceedings O.M.P.(MISC.)(COMM.) 53/2019 and rendering the award. The time which has been spent between
19.08.2018 till today will stand regularised. Needless to say, anything stated in the petition will not impact the case of the respondent in the arbitration proceedings.
4.
The petition is disposed of.
