Counsel for the petitioner says that it is the stand of the petitioner that two Arbitrators appointed by the respondent have already resigned and despite request made for appointment of a substitute Arbitrator as far back on 15.09.2018, there has been no movement in the matter. 3.

It is the petitioner's case that respondent has lost its right to appoint an Arbitrator in the matter.

Surprisingly, Mr. Praveen Kumar Jain, who, appears on advance notice on behalf of the respondent says that he has no instructions in the matter.

The entire purpose of respondent being given advance notice is that unnecessary delay in respect of such matters does not take place. 6.

The concerned authority will take note of this so that adjournments on this ground are not taken in other matters. 7.

At request of counsel for the respondent, renotify the matter on 08.02.2019.
