The present Writ Petition has been filed with the following prayers: "a) Issue an writ in the effect of Certiorari thereby quashing order dated 14.08.2023 issued by the respondents; and b) Issue an writ in the effect of Mandamus thereby directing the respondents to refund the stamp papers bearing no. IN DL26947040985408S dated 26.02.2020 for an amount of Rs.

2,52,000/- and IN DL28947649871041S dated 26.02.2020 for an amount of Rs. 2,40,000/and c) A writ, order or direction awarding the petitioner interest on the amounts being held by the respondents at the rate of 18% P.A. from the date of application of refund till the date of actual realisation; or d) A writ, order or direction in the nature of mandamus commanding the respondents not to forefeet the stamp The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. e) Pass any other or further order/ direction as deemed fit.

f) Mould, issue and grant any other writ, order or direction as may be deemed fit and proper in the facts and circumstances of the case;

g) Also award the cost of this petition to the petitioner."

Both sides are ad idem that the issue raised in the present Writ Petition is squarely covered by the Judgment of this Court in Citius Real Estate (P) Ltd vs Union of India & Ors, 2023:DHC:8398-DB. 3.

In view of the above, the impugned Order is remanded back to the Collector of Stamps for reconsideration of the issue in light of the abovementioned Judgment and take a decision in the matter within four weeks from today.

With these observations, the Writ Petition is disposed of along with the pending applications, if any.

Liberty is granted to the Petitioner to approach this Court if need arises in future.
