The Petitioners claim to be the authorised representatives of the respective District General Bodies for Kabaddi i.e., Rohtak, Jind, Kaithal, Yamuna Nagar, Panchkula, Jhajjar and Karnal of Respondent No. 3 - Amateur Kabaddi Association of Haryana1. The Petitioners have filed the instant writ petition seeking inter-alia appointment of an ad hoc committee as well as a Returning Officer for conduct of fresh elections of AKAH, 1 "AKAH"

along with other ancillary reliefs, in accordance with the National Sports Development Code, 2011 and in light of the Judgment of this Court in Jitender Kumar Gahlyan v. Union of India2.

On the other hand, Mr. Amit Peswani, counsel representing Respondent No. 2 - Amateur Kabaddi Federation of India3, the national level federation for the sport of Kabaddi, has pointed to a communication dated 17th March, 2024 issued by AKAH to Respondent No. 2. The said communication is handed over across the board and taken on record. The said communication is as follows:

"Dear Sir, With reference to the above this is to bring your kind notice that none of the petitioners District Kabaddi Association in the above titled writ petition are affiliated units of the AKAH. In fact they are parallel association to the duly affiliated and recognized District Kabaddi Association of the active in the concerning District. This is to further bring to your kind notice that some of the district associations failed to conduct their due elections on time, therefore, the elections of such District associations were go conducted by appointing an Ad hoc Committee, strictly as per the National Sports Development Code. This is for your kind information and record." 3.

As per the aforenoted communication, none of the Petitioners who claim to be District Kabaddi Associations are affiliated with Respondent No. 2 - AKAH. In fact, according to AKAH, the Petitioners operate as parallel associations to the duly affiliated and recognised associations of AKAH which are active in the concerned Districts.

In light of the above, since the Petitioners are not recognised or affiliated units of Respondent No. 2 - AKAH, they cannot seek the conduct 2 2023 SCC OnLine Del 779 3 "AKFI"
