The present petition has been filed seeking setting aside of the vacation notice dated 26th November, 2025 in respect of Property no. 1598, Top Floor, Saini Basti Kotla Mubarakapur, Lodhi Road, Delhi 110003, and restraining the respondent/MCD from taking coercive action in terms of the said notice.

Pertinently, the aforesaid vacation notice is dated 26th November, 2025. The present writ petition was filed on 12th February, 2026, and the same is listed for the first time today, i.e., 17th March, 2026. 4.

Counsel appearing on behalf of the respondent/MCD points out that pursuant to the aforesaid vacation notice, demolition action has already been carried out in December, 2025.

He further submits that the vacation notice was issued after issuance of the show cause notice, followed by a demolition order. 6.
Copies of the show cause notice as well as the demolition order have been handed over to counsel for the petitioner in the Court today. 7.
In view thereof, the present writ petition filed under Article 226 of the Constitution of India cannot be entertained.

Accordingly, the writ petition is disposed of, while giving liberty to the petitioner to invoke the statutory remedy of appeal and approaching the Appellate Tribunal, MCD.

The pending application stands disposed of.
