Learned APP accepts notice for respondent no. 1.

Respondent No.2 is present in Court and has been identified by SubInspector Vijay Kumar of police station Farsh Bazar. Respondent no. 2 submits that she has settled the matter with petitioner no. 1 of her own free will and without any undue force, pressure or coercion before Delhi Mediation Centre, Karkardooma Courts, Delhi on 4th December, 2015.

Her marriage with petitioner no.1 has already been dissolved on 1st April, 2017 by way of mutual consent passed by the Family Court, Shahdara, Karkardooma Courts, Delhi. She further submits that she

has already received entire settled amount and has no objection in case FIR No.536/2015 under Sections 498-A/406/34 IPC registered at Police Station Farsh Bazar is quashed against the petitioner no.1 and his relatives, that is, petitioner nos. 2 to 6. Affidavit of respondent no. 2 is also on record to this effect.

Keeping in mind the facts and circumstances as detailed above, more particularly the fact that marriage of petitioner no. 1 and respondent no. 2 has already been dissolved, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.
