The present application has been filed on behalf of the petitioner under Section 151 of the Code of Civil Procedure, 1908 ("CPC") seeking to withdraw the present cancellation/rectification petition. It is submitted that pursuant to the filing of the present petition the parties engaged in constructive dialogue aimed at resolving the underlying issues. Thus, the parties have settled their disputes by way of a Settlement Agreement. The said Settlement Agreement has been mutually agreed upon, accepted and formally recorded before the Division Bench of this Court, vide order dated 19th September, 2024.

Thus, in lieu of the amicable settlement arrived at between the parties and in order to honour the terms of the same, the present application has been filed seeking to withdraw the present cancellation petition. 4.
Issue notice. Notice is accepted by learned counsel appearing for the respondents, who confirms the terms of the settlement arrived at between the parties.

Accordingly, the present cancellation petition is dismissed as withdrawn.

The next date of hearing of 02nd December, 2024, stands cancelled.
