% 13.01.2016 Learned counsel for the parties inform this Court that the suit pending before the Trial Judge is a suit filed by the present petitioner against the directors of the company M/s. Herman Properties Ltd. (hereinafter referred to as the 'Company'). The petitioner/tenant had filed an application under Order 1 Rule 10 of the CPC seeking impleadment of the Company as the submission of the learned counsel for the petitioner is that it was not known to him that the property is owned by the Company. Learned counsel appearing for respondents No. 2 & 3 states that he would make an appropriate statement before the concerned Trial Court including the filing of the Resolution of the Company that the Company would not dispossess the petitioner/tenant without due process of law.

In view of this submission made by the learned counsel for

respondents No. 2 & 3, learned counsel for the petitioner does not press this petition.

Petition disposed of.
