% 15.09.2016 The admitted case is that the present suit is filed by the petitioner claiming a decree of permanent injunction restraining the defendants etc. from dispossessing the plaintiff/petitioner from the shop situated at property No. 10/6776 D.B.Gupta Road, Dev Nagar, Karol Bagh, New Delhi. Learned counsel appearing for the LRs of respondent No.1-Satnam Singh submits that without prejudice to his rights and contentions, he would be willing to make a statement before the trial court that his client would not dispossess the petitioner from the suit property except by due process of law. Learned counsel for the parties submit that respondents No.1 and 2 have already made a similar statement.

In view of the above, learned counsel for the petitioner submits that once the statement of respondent No.1 is recorded, he would be willing to withdraw his suit and he seeks to withdraw the present petition. Accordingly, the petition is dismissed as withdrawn. SEPTEMBER 15, 2016/rb JAYANT NATH, J
