% 17.08.2016 Petitioner is aggrieved by the fact that illegal and unauthorized construction is being carried out at property no. S-70, Greater Kailash I, New Delhi which is against the bylaws. Status report has been filed by the respondent no.1. The stand of respondent no.1 was that demolition order has been passed qua the said property. Today it has been informed to the Court that the private respondent namely respondent no.2 had filed an appeal in the appellate tribunal, i.e. ATMCD against the demolition order and the ATMCD vide its order dated 15.07.2016 has stayed the demolition process and appeal is yet

pending in the ATMCD.

In view of the above, the petition does not survives and the same is disposed of with liberty granted to the petitioner to approach this Court if he is aggrieved by the Department not taking any action in accordance with law.
