The parties do not dispute that the controversy involved in the instant petition stands covered by the decision of this Court in Rajan Verma v. Delhi State Industrial Infrastructure Development Corpn. Ltd.1 2.

Learned counsel appearing for the respondent, however, submits that in the instant case, the order of debarment is not under challenge. The petitioner, however, contends that the show cause notice is under challenge and the action pursuant thereto was stayed by the Court vide interim order dated 06.03.2025, therefore, the order of debarment ought not to have been issued.

Since the main controversy is covered by the decision passed by this Court in Rajan Verma, therefore, the same benefit will have to be extended to the petitioner. If the show cause notice itself is held to be illegal and was stayed, there is no reason to pass an order of debarment. A similar order of debarment has been set aside by the Court.

Accordingly, both, the show cause notice as well as the debarment order, are set aside in terms and liberty of the decisions passed in Rajan Verma.

Petition stands disposed of.
