Petitioner is resident of Mehrauli and is aggrieved by the manner in which the adjacent property, which is also meant for residential use, has been converted for commercial use.

It is submitted that the godowns are being run in the name of "Tulsi Marbles" and various sanitary items are being stored in the godowns, without there being valid permission and sanction for said purpose. 3.

petitioner is situated in a residential area of Mehrauli, which is a densely populated area and the abovesaid misuse has not been stopped by the respondents, despite the fact that their attention was drawn on several previous occasions by sending representations, one after the other. 4.

Learned counsel for respondents appears on advance notice. 5.

Learned Additional Standing Counsel for respondent No.2/MCD appears through video-conferencing and submits that the MCD has already initiated requisite action and a notice under Section 345A DMC Act has already been issued to the concerned occupier/owner and further appropriate action including sealing, etc. shall be carried out after hearing the response, if any, of such occupier/owner.

He also submits that there would not be any further delay in the matter and it will be ensured that further requisite action is carried out within a period of four weeks from today.

In view of the abovesaid statement and assurance given by learned additional standing counsel for respondent/ MCD, learned counsel for petitioner, at the moment, does not press the present petition. He, however, seeks liberty to revive the petition or to file petition afresh, in case, the grievance of petitioner is not taken care of, in the requisite manner. 8.

Petition is disposed of in aforesaid terms.

Liberty, as prayed, is granted.
