After some arguments, learned Counsel for the Petitioner submits that he would be satisfied if a direction may be passed that the contentions raised by the Petitioner in the present Petition be examined by the learned Trial Court at the appropriate stage.

It is so directed. The Petitioner is permitted to agitate all contentions raised in the present Petition before the learned Trial Court at the appropriate stage. All rights and contentions of both parties are left open in this regard.

It is also clarified that the finding in the Impugned Order dated 09.11.2021 would be taken as a prima facie finding by the learned Trial Court.
